Welcome to BikeGarage. By using our website, you agree to comply with and be bound by the following terms and conditions. Please review these carefully before accessing or using our website or any related services.

1. Acceptance of Terms

By accessing or using any part of the BikeGarage website (the "Site") or any services provided by BikeGarage, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or any of its services.

2. Eligibility

You must be at least 18 years old to use our services. By using the Site, you represent and warrant that you are of legal age and competent to enter into a binding contract.

3. Services Provided

BikeGarage provides services including but not limited to bike locker rentals, bike garage access, and related services ("Services"). These Services are subject to availability and may be modified or discontinued at any time without prior notice.

4. Payment Terms

By using our Services, you agree to pay all fees or charges applicable to your chosen service (e.g., monthly or annual subscriptions). Payments are processed through a third-party payment processor, and you agree to their terms and conditions. All fees are non-refundable, except as required by law.

5. User Responsibilities

  • Appropriate Use: You agree not to misuse our services or use the Site for any illegal or unauthorized purpose.

  • Compliance: You agree to comply with all applicable local, state, and federal laws regarding the use of the Site and Services.

  • Prohibited Actions: Users are prohibited from scraping, data mining, or accessing our site by automated means, and from interfering with the normal operation of the Site.

6. Locker and Garage Usage

  • Locker Access: Rental agreements are valid for the term selected (e.g., monthly or annual). BikeGarage reserves the right to terminate any rental agreement at any time for any reason, to include illegal activity or otherwise.

  • Garage Access: Garage facilities must be used according to provided guidelines. Any misuse, such as illegal parking or improper storage, may result in termination of access rights with a pro-rated refund.

  • Liability: BikeGarage is not responsible for theft, damage, or loss of personal property stored in lockers or garages, except as explicitly stated in a separate agreement or as required by law.

  • E-Bikes: You will not store an E-Bike battery in any BikeGarage locker or garage facility unless it is UL Certified. Failure to follow this instruction may make you liable for damage occurring to BikeGarage facilities and property.

7. Intellectual Property

All content on the Site, including but not limited to text, images, logos, and code, is the property of BikeGarage and protected by intellectual property laws. You may not copy, reproduce, or distribute any content without prior written permission from BikeGarage.

8. Termination of Services

BikeGarage may, in its sole discretion, suspend or terminate your account or access to Services at any time for breach of these Terms. Upon termination, your right to use the Services will immediately cease, and all provisions of these Terms that should survive termination will remain in effect.

9. Disclaimer of Warranties

BikeGarage provides the Site and Services "as is" and without any warranty or condition, express, implied, or statutory. BikeGarage specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall BikeGarage or its affiliates be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services. BikeGarage’s maximum liability will not exceed the fees you have paid to us in the past 12 months.

11. Indemnification

You agree to indemnify and hold BikeGarage harmless from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising out of your breach of these Terms or your use of the Services.

12. Modifications to Terms

We may modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site or BikeGarage services following the posting of changes constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms and your use of the Site and Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services will be resolved through binding arbitration in Philadelphia, PA, in accordance with the rules of the American Arbitration Association.
